In a recent event, the UP Chief Minister ordered one of his political party’s MLA”s aides to pay for the damages done by him on a public property.

The incident took place in a district in UP when, a part of a road, connecting Shahjahanpur to Budaun, was allegedly dug up with the help of a bulldozer by a representative of a BJP MLA. Superintendent of Police (SP) Ashok Kumar Meena told the media that the road is being constructed from Jaitipur via Nawada to Budaun district.

The MLA’s aide Jagveer Singh, along with 15 to 20 associates, had dug up the road on October 2 night using an excavator as the contracting company refused to pay ‘tax’, also termed as ‘goonda tax’ for the construction of the same without ‘permission’.
After an FIR was lodged by the contractor, UP CM Yogi took a stern view on the incident and directed officials to get hold of the accused and asked BJP MLA Dr. Veer Vikram Singh‘s associate to pay the full amount of the damages done by him on public property.

According to the FIR, the Gorakhpur-based firm, that was constructing the seven-km road at a project costing Rs 12.5 crore and Jagveer Singh, citing himself to be an associate of the local BJP MLA, demanded 5 percent of the project cost as ‘tax’. The accused and his associates for the past few months have been threatening and bashing up our workers on site.
Additional District Magistrate Sanjay Kumar Pandey said detailed information has been sought from the executive engineer of the PWD and a team formed under the Tilhar sub-divisional magistrate (SDM) to probe the matter.
According to a government statement, Divisional Commissioner Saumya Agrawal has issued an order to Public Works Department (PWD) chief engineer Sanjay Tiwari to do an assessment of the damage to the road and the monetary loss due to it.

Legal action will be taken after the team submits its report; the road construction work has started again and police have been asked to provide adequate security to the workers.
A senior official in Lucknow said the chief minister has taken note of the incident and directed for full recovery of the damage from those who have dug the road.
The Jaitpur police in Shahjahanpur have filed the case under the Damage to Public Property Act 1984 and other relevant sections. Raids are being conducted to arrest all the accused.
